False Hope


The iconic Obama “Hope” image created by artist Shepard Fairey has led to a series of lawsuits. Fairey used a photo taken by AP photographer Mannie Garcia to create his image. The AP is arguing copyright infringement while Fairey claims the image falls under fair use provisions. Garcia, now a freelancer, wants no part of the argument. paidContent.org sums everything up. Since this is a case of copyright infringement, i think there is thousands of pictures of the president. So, why is this particular picture causing so much chaos? Because someone in some small way copied the picture with a painting. I think its bullshit and just something the media enhanced for publicity. There are bigger problems in the world that a picture argued by who's gonna make more money.

Pretty obvious that Fairy used Garcia's picture as a starting poing for his own picture. I dont really blame the AP for this lawsuit because like they said, they are just protecting their own journalists.

First off I think its right that Fairy is being sued because He states that he used the AP's photo as a reference, so its only right that the AP should be seeing a profit off the picture as well.

Also after just reading an article about Steelerbaby and how Fairy sued for infringement because of the word "Obey"... I don't see why Fairy should complain about his law suit for the Obama Picture.

I feel that both sides have a good argument. I think that Shepard Fairey was wrong for not crediting the AP and Mannie Garcia. You should always credit someone for an idea/reference you use that is based off their work.

I think Fairy should pay for using Garcia's picture. He clearly would not have made his illustration of Obama without the original picture provided by the APP. Even though Fairy claims all the money he has made off of the picture goes to the making of future posters and charity does not mean that Garcia should not be able to make money off his own photo.

By taking a protected copyrighted image from the AP then manipulating it into a different image without crediting the original photographer or asking permission isn't legal. Hopefully Shepard Fairey certainly has "false hope" in winning this suit.
